There are ways to launch before the GENIUS Act becomes effective, one of which is working with a licensed service provider to issue payment stablecoin while working on your own GENIUS Act application.  If your goal is to issue a payment stablecoin that can scale nationally and survive regulatory scrutiny, working with a licensed service provider early is often the least risky path. 

As a lender, you need to conduct due diligence on the valuation of digital assets and the scope of rights that an owner/borrower possesses. As a borrower, you need to ensure that your digital assets are correctly assessed in terms of value and that you are not giving away all the rights to your digital assets in such secured financings. In this regard, new UCC Article 12 sets out new rules, including a new method of perfection for such security interests.
